Regulations of the Massage Parlour
Appendix 10 to the Regulations of Rezydencja Aqua
The Regulations were created for your safety and comfort. Please read the Regulations and follow them.
§1
General Provisions
1. The Regulations specify the rules for using and staying in the massage parlour at Rezydencja Aqua in Szklarska Poręba at ul. Urocza 7A, 58-580 Szklarska Poręba, run by Rezydencja Szklarska Poręba sp. z o.o. , headquartered in Jelenia Góra at the following address: ul. Szkolna 5/7, 58-500 Jelenia Góra, for which the registration files are kept by the District Court for Wrocław-Fabryczna, IX Commercial Division of the National Court Register, under KRS number 0000752079, tax identification number (NIP): 6112797981. These Regulations will be hereinafter referred to as the “Regulations”.
2. The massage parlour at rezydencja Aqua is managed by Rezydencja Szklarska Poręba sp. z o.o. z, headquartered in Jelenia Góra, at the following address: ul. Szkolna 5/7, 58-500 Jelenia Góra, numer KRS: 0000752079.
3. The services provided by the massage parlour can be used by the guests of Rezydencja Aqua as well as the external guests (hereinafter referred to as “Guests”).
4. The Regulations apply to all Guests staying in the massage parlour.
5. Before entering the massage parlour, please read the Regulations. The Regulations are available at the reception of Rezydencja Aqua, in the massage parlour and in the website: www.rezydencjaaqua.pl.
6. The use of the services provided by Rezydencja Aqua is subject to payment, in accordance with the price list offered by Rezydencja Aqua (hereinafter referred to as: “Massage Parlour Price List”), with the exception of the massage parlour services covered by the Reservation purchased under the apartment rental agreement concluded with Rezydencja Aqua.
7. The Massage Parlour Price List is available at the reception of Rezydencja Aqua, in the massage parlour and in the website: www.rezydencjaaqua.pl.
§2
Rules for using the massage parlour
1. Massage Parlour is a relaxation zone. It is obligatory to maintain peace and quiet. For the sake of relaxation, Guests are asked not to bring mobile phones or to turn them off.
2. Adult guests are allowed to use the massage parlour services. Minor guests under the age of 18 may use the massage parlour only with a written consent of their legal guardian. Guests, who are over the age of 13, may use massage parlour services intended for this age category only with a written consent of their legal guardian and with their company.
3. You can stay in the massage parlour only during its opening hours. The massage parlour provides services from Monday to Sunday, between 10:00 a.m. and 08:00 p.m. (depending on the seasons/occupancy of the facility, days and hours may vary).
4. For the Guests’ comfort it is advisable to come for a treatment to the massage room wearing a bathrobe, which is available at each apartment. Most treatments performed in the massage room are performed without clothes - always in underwear. Before the treatment the Guest receives disposable treatment underwear.
5. Before the treatment it is recommended to take a warm shower for greater relaxation and comfort. In order to increase the effectiveness of the treatment, it is recommended to drink large amounts of still water before and after the treatment, avoid large meals and drinking alcohol before the planned treatment, as well as avoid sunbathing immediately before and after the treatment.
6. In order to avoid irritation, men planning to undergo facial treatments in the massage room, are recommended to shave their face at least 12 hours before the scheduled treatment.
7. In order to avoid irritation, women planning to undergo body treatments, are recommended to depilate the body at least 24 hours before the scheduled treatment.
8. The services of the massage parlour are cosmetic or relaxation treatments, and are not medical treatments. The effects of the treatments depend on many factors, such as: health condition, age, the amount of the performed treatments.
9. The Guest planning to use the massage parlour services should be aware of his/her health condition and refrain from using treatments that may threaten his/her life or health. The Guest should use the chosen treatment only if there are no contraindications to using them. Before the treatment starts, the Guest should complete and sign a consultation card by providing true information about his/her health condition.
10. There are certain general contraindications to using the services of the massage parlour, in particular body treatments and massages. The general contraindications to performing a massage or treatments include:
- body implants,
- heart defects,
- having a peacemaker,
- condition after heart attack,
- fresh scars,
- unhealed wounds,
- skin inflammation,
- hematomas and aneurysms,
- skin hypersensitivity,
- mycosis,
- warts,
- epilepsy,
- vein diseases, including varicose veins,
- thrombophlebitis,
- advanced hypertensive disease,
- atherosclerosis,
- cancer diseases,
- diabetes,
- tendency to hemorrhage,
- hemophilia,
- acute or subacute inflammation,
- advanced osteoporosis,
- infectious diseases of the respiratory system,
- pneumonia, bronchitis,
- asthma,
- fever,
- early period after fracture, sprain, dislocation,
- early period after medical procedure,
- breastfeeding.
The descriptions of each treatment and massage, which are available in the website www.rezydencjaaqua.pl/spa and in printed form in the massage room, contain contraindications dedicated directively to a given treatment and massage. In case of doubt, the Guest should consult a doctor before using the massage parlour services.
11. Treatments in the massage room are performed on pregnant women only after receiving a written consent of the attending physician.
12. In case of bad feeling or discomfort during the ongoing treatment, the Guest should inform the person performing the treatment immediately.
13. On the premises of the massage parlour it is prohibited:
a. smoking tobacco or other intoxicants,
b. smoking e-cigarettes,
c. bringing and drinking alcohol, drugs and other intoxicants,
d. bringing and eating food,
e.bringing own aromas and fragrances,
f. performing cosmetic treatments independently,
g. behaviour disturbing relaxation atmosphere,
h. behaviour generally considered indecent or offensive,
i. recording sound or image, taking photos,
j. tampering with devices constituting the equipment of the massage parlour,
k. introducing animals.
14. People under the influence of alcohol, drugs or other intoxicants, are not allowed in the massage parlour.
15. People staying in the massage parlour should follow the staffs’ recommendations.
16. The massage parlour staff has the right to refuse entry to the massage room or ask the person to leave the massage room if they:
a.are under the influence of alcohol, drugs or other intoxicants,
b. did not pay the fee due for the procedure,
c. disturb relaxation atmosphere,
d. do not follow the recommendation of the staff,
e. otherwise violate the provision of the Regulations.
§3
Reservation and conclusion of the contract
1.Before booking a treatment in the massage parlour, the Guest should read the Regulations.
2. Reservations of the treatments can be made:
a.in person at the reception of rezydencja Aqua
b. by phone or text message at the following number: +48-791-96-11-77
c. via e-mail under the following address: spa@rezydencjaaqua.pl.
3. In order to book a treatment, the Guest should provide: apartment number, name and surname, type of treatment and preferred date of the treatment. An agreement for the provisions of the services between the Guest and Rezydencja Aqua is concluded when the Guest receives a confirmation of the treatment reservation from Rezydencja Aqua.
4. A Guest, who is entitled to a treatment as part of the purchased special offer/stay package, covered by the Reservation and purchased as part of the apartment rental agreement concluded with Rezydencja Aqua, should immediately contact a massage parlour by phone after making the purchase at +48-791-96-11-77 or by text message or via e-mail at the following address: spa@rezydencjaaqua.pl in order to book a date convenient for himself, taking into consideration in these regulations (§6, pkt. 3) hours, i.e. 10:00 a.m. - 03:00 p.m., during which such treatments are performed. In case of lack of contact from the Guests, the office reserves the right to set a date for the service under pain of failure to provide it on a different date.
5. The Guest should arrive at the reception of the massage room 5 minutes before the scheduled time with a document confirming payment for the ordered treatment. In case of being late, the treatment duration may be shortened.
6. Before the treatment starts, the Guest should complete and sign a consultation card by providing true information about his/her health condition. Completing a consulting card includes:
a.providing name and surname and apartment number,
b. providing information about health condition and consent to the processing of personal data about health condition by Rezydencja Aqua in order to provide services in the massage parlour,
c. confirmation of reading the regulations and consent to the procedure.
Failure to fill or incomplete fill the consultation card, as well as failure to sign it, will prevent you from receiving treatment in the massage parlour.
7. The Guest is entitled to cancel the reservation of a treatment in the massage room at least 24 hours before the scheduled procedure without incurring the costs of the canceled reservation (does not apply to treatments as part of a purchased special offer/stay package covered by the Reservation and purchased as part of the apartment rental agreement concluded with Rezydencja Aqua). Resignation should be reported at the reception of Rezydencja Aqua via e-mail at the following address: spa@rezydencjaaqua.pl or by text message at: +48-791-96-11-77. In case of cancellation of the reservation made less than 24 hours before the scheduled treatment or the Guest’s failure to show up for the scheduled treatment due to his/her fault, Rezydencja Aqua may claim compensation from the Guest for the damage suffered by Rezydencja Aqua on general principles specified in the law.
8. The fee for using the services of the massage parlour must be paid at the reception of Rezydencja Aqua before the scheduled procedure.
§4
Liability
1.The Guest is liable for damages caused by his/her fault, including damages caused by minors under his/her care, on general principles in accordance with provisions of generally applicable law, in particular the Civil Code.
2. Rezydencja Aqua is liable to the Guest for the proper performance of the services in the massage parlour in accordance with the principles set out in the provisions of generally applicable law, in particular the Civil Code.
§5
Personal data protection
1. The Co-Administrators of Guests’ personal data processed in the massage parlour (hereinafter referred to as “Personal Data”) are: Rezydencja Aqua, headquartered in Jelenia Góra at ul. Szkolna 5/7, 58-500 Jelenia Góra, under KRS number: 0000752079, e-mail address: biuro@rezydencjaaqua.pl, and I Masz Sp. z o.o., headquartered in Jelenia Góra at ul. Zaułek 15a/9, 58-500 Jelenia Góra, under KRS number: 0000395689, e-mail address: spa@rezydencjaaqua.pl.
2. Personal Data are processed by the Co-Administrators for the following purposes:
a.conclusion and performance for the provisions of the services (legal basis: Art. 6(1)(b) of the GDPR),
b. consideration of complaint (legal basis: Art. 6(1)(b) of the GDPR),
c. determining, pursuing or defending against claims (legal basis: Art. 6(1)(f) of the GDPR), which constitutes the legitimate interest of the Co-Administrators.
3. The Administrator of Personal Data regarding health is Rezydencja Aqua, headquartered in Jelenia Góra at ul. Szkolna 5/7, 58-500 Jelenia Góra, under KRS number, and the basis for the processing is the Guest’s consent, granted in order to perform the contract for the provision of services (legal base: Art. 9 (2)(a) of the GDPR).
4. detailed information about all purposes of Personal data processing and the principles of their protection is included in the massage parlour consultation card, which the Guest completes before using the massage’s parlour services.
5. Providing Personal Data indicated on the consultation card, including health data along with consent of their processing, is voluntary but necessary in order to use the massage parlour services. Failure to provide name and surname or apartment number, type of treatment and preferred date of treatment, makes it impossible to book a treatment.
6. The main content of the arrangements between the co-administrators is available at the reception of Rezydencja Aqua and in the massage parlour.
7. In all matters related to the processing of Personal Data by the co-administrators, you may contact us via e-mail to the following address: biuro@rezydencjaaqua.pl or in writing to the following address: Rezydencja Szklarska Poręba sp. z o.o., Urocza 7A, 58-580 Szklarska Poręba, as well as I Masz Sp. z o.o., headquartered in Jelenia Góra at ul. 8. Each person, whose Personal Data is processed, has the right to:
a. access to their Personal Data,
b. supplement and correct their Personal Data,
c. delete their Personal Data,
d. limit the processing of their Personal Data,
e. object to the processing of their Personal Data,
f. transfer their Personal Data,
g. withdrawal consent at any time if the processing of Personal Data is based on consent, which does not affect the lawfulness of processing based on consent before its withdrawal.
9. In the event of the violation of the provisions of the protection of personal data, the data subject may submit a complaint regarding the processing of his/her Personal Data to the President of the Personal Data Protection Office. A complaint may be submitted in person at the office of the President of the Personal Data Protection Office at ul. Stawki 2, 00-986 Warszawa or send it to the President of the Personal Data Protection Office, indicated above.

§6
Final Provisions
1. The term “Rezydencja Aqua” used in the Regulations means - depending on the context - the facility of Rezydencja Aqua or the company indicated in § 1 (1) of the Regulations.
2. Treatments purchased as part of a special offer/package stay, covered by the Reservation and purchased under the apartment rental agreement concluded with Rezydencja Aqua, cannot be exchanged for any other service available in the massage parlour.
3. Treatments purchased as part of a special offer/package stay, covered by the Reservation and purchased under the apartment rental agreement concluded with Rezydencja Aqua, are provided between 10:00 a.m. - 03:00 p.m.
4. The prices of the treatments purchased as part of a special offer/package stay, covered by the Reservation and purchased under the apartment rental agreement concluded with Rezydencja Aqua, are not subject to discounts resulting from parallel promotional campaigns regarding services available in the massage parlour.
5. In matters not regulated in the Regulations, including matters relating to the complaint procedures, the provision of the Regulations of Rezydencja Aqua , as well as the provisions of generally applicable law, in particular the Civil Code, apply. The Regulations of Rezydencja Aqua are available, in particular, at the reception of Rezydencja Aqua and on the website: www.rezydencjaaqua.pl/apartamenty-szklarska-poreba.
6. The regulations are valid from February 15, 2024.
